Model Photography Release

When to Get a Model Photography Release

A model photography release is always required if the publication is that of a commercial one. If the publication is only used to inform or educate, then a release is not needed.

This basically means that if the photo is going to be used to sell, advertise or persuade consumers to purchase an item, a signed release from the photographer is going to be needed.

A good example of a commercial need is any photography with models. High fashion model photography, most commonly consisting of a girl, woman or teenagers, will be used for commercial publication.

Photography of models who work for any talent agency, whether they are a beginner or not, will all need a model photography release before the photos can be used legally.

If the photos are used anyway without getting the proper release form, serious consequences are likely to soon follow because using the photos for commercial purposes without a release is against the law in most states. To protect yourself from getting into trouble and keeping your reputation, always be sure to get a release form before using any model photos for commercial purposes. Failure to do so is going to result in a major headache and could also get quite expensive.

Final thought: If you are still not certain you need a release, check with a knowledgeable attourney in your state. Better safe than sorry.
